The Court has also reviewed the Partial Disposition submitted by United States Magistrate Judge Joe J. Volpe. No objections have been filed. After careful consideration, the Court concludes that the Partial Disposition should be, and hereby is, approved and adopted in its entirety as this Court's findings in all respects. The Court has also reviewed the Proposed Findings and Recommended Disposition submitted by Judge Volpe. No objections have been filed. IT IS THEREFORE ORDERED that:

1. Plaintiff Jaggars's Motion to Dismiss Party (Doc. No. 6) is GRANTED;
2. Plaintiff's cause of action be DISMISSED without prejudice for failure to state a claim upon which relief may be granted;
3. Dismissal of this action count as a "strike" for purposes of 28 U.S.C. § 1915(g)[1];
4. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that an in forma pauperis appeal from this Order would not be taken in good faith.
